Expectations

If you are like most of our customers, this is probably your first experience with a new roof installation and you are curious about what to expect. The most important point to be aware of is that we cannot install a new roof on your home without causing some inconvenience.

Deposit: Bardin Roofing requires a deposit of the ACV (Actual Cash Value) payment and any out-of-pocket costs to commence your project. This must be received by the day materials are delivered.
Access: We will need access to your driveway to place our dump trailer, load materials, and perform cleanup. Please keep your driveway clear and remove any vehicles from the garage prior to the day of installation. Your contract price was determined based on our ability to access the driveway for our trucks and use of electricity. If exterior plugs are not available, please run an extension cord through a window or door.
Cleanup: There will be a thorough cleanup of the exterior of your premises. However, we cannot guarantee that we will be able to pick up 100% of the nails that fall during the construction of your roof. Future rainfalls will most likely expose missed nails. Please check around the downspouts and in the driveway after the first few heavy rain showers. It is the customer’s responsibility to inspect these areas after Bardin Roofing has completed the project. We cannot be held responsible for any damages such as flat tires after we have vacated the premises.
Communications: If you have any questions or problems with your roof job, please contact your consultant or the office immediately. We can finish most jobs in one or two days. However, additional time may be needed based on the size of the roof, weather/rain days, or any other circumstances out of our control.
Driveway: Bardin Roofing uses dump trailers for all of our roofing installations. We cannot be held responsible for any cracks in a customer’s driveway.
HOA: If you have an HOA, it is recommended that you check with the association for shingle color approval prior to installation. Bardin Roofing is not responsible for any disputes between a homeowner and their HOA for services we perform.
Landscaping and Outdoor Décor: We will make every effort to protect your landscaping. However, we cannot be held responsible for damaged items such as grass, flowers, shrubs, outdoor lights, etc., during the tear-off process. Cleaning outdoor décor from the work zone such as benches, chairs, potted plants, tables, yard gnomes, etc., is the sole responsibility of the customer.
Leftover Materials: We over-order materials for every job to ensure they are completed in full. Any leftover materials remain the property of Bardin Roofing.
Lighting Fixtures, Mirrors, Pictures, and Interior: These items can fall if not firmly attached to the wall or ceilings. We suggest that you check to make sure they are secured. If in doubt, take them down. We cannot assume responsibility for these items as a result of the roof installation. Small cracks or crow’s feet may appear in older plaster, and small particles of the acoustical ceiling may fall. We cannot assume responsibility for these items as a result of the installation either.
Pest Control Barrier System and Gutter Guards: It is common for these items to become damaged during the removal process. We strive to work around them during removal, but there are times when damage is inevitable. We cannot assume the cost of repair or loss of warranty for either product. Arrangements to remove and replace these items are the sole responsibility of the customer.
Pools, Hot Tubs, and Outdoor Water Features: We cannot be held responsible for covers or the filtration systems of these items.
Ridge Vents: We recommend installing ridge vents on all new roofs we build. This allows both heat and moisture to escape, thus extending the life of your roof. This will replace any existing vents on the roof unless otherwise specified.
Safety: Please keep small children and animals away from the work area at all times.
Satellite Dish: We will remove and replace your satellite dish. However, we do not have the necessary equipment to re-align the dish for proper reception. We cannot be held responsible if your carrier needs to be called to re-align the dish upon completion.
Shingles: Several types of shingles are sent to the job. One is a starter shingle used around the perimeter of the roof. The other shingles are the brand and style of the shingles you requested to be installed.
Siding and Stucco: It is common for the siding and trim that meets the roofline to be rotted from years of exposure to water. We cannot be held responsible for damage to the siding or trim during the replacement of your roof due to rot, brittleness, or delamination. Local building code clearance requirements state that all siding must clear the roofline by a minimum of one inch. We must also be made aware of any stucco warranty before construction begins.
Skylights: If skylights are replaced, they are included in the warranty. If skylights are not replaced, they will not be included in the warranty. We cannot be held responsible for interior damage when removing shingles and old flashing around skylights.
Solar Panels: Arrangements to remove and replace solar panels are the sole responsibility of the customer.
Tear Off: While removing your existing roof(s), it is likely that debris will fall through your lath or decking into the attic. We suggest covering or removing any items which require protection. Also, the dump trailer is for Bardin Roofing use only. If the customer puts personal articles in it, an extra fee will be charged.
Vents: At the end of each workday and upon completion of your job, you agree to check the interior connections of your furnace and hot water vent pipes. If you cannot check these items, please notify us and we’ll inspect them for you. We cannot be held responsible for pipes that might come loose during installation.
Warranty Information: All work performed will be warranted for two years unless noted differently on this agreement. You will receive your material and labor warranty information for all services approximately 60 to 90 days after we have received payment in full.
Wiring and Air Conditioning Lines: Electrical, telephone, security, and air conditioning lines should not be installed directly underneath the roof decking. If you are aware of any such lines, we must be notified immediately. We cannot be held responsible for the puncture of improperly installed lines within three inches of the roof deck.
Yard Sign: Placing a sign on your property is the first step in the new roof installation of your home. We are proud of this job and our craftsmanship. It also makes it simple for your neighbors to contact us should they have any questions or concerns.

Terms and Conditions

Communication Authorization: This agreement enables Bardin Roofing LLC to communicate with the insurance company on the homeowner’s behalf. The homeowner agrees to allow Bardin Roofing LLC to perform work in accordance with the type and amount paid by the insurance company.
Cancellation Rights: You may cancel this agreement at any time before midnight on the fifth business day after the effective date or until the materials have been delivered, whichever comes first. The right to cancel is in addition to any other rights of cancellation which may be found in state or federal law or regulation.
Attorney’s Fees and Costs: In the event of one or more events of default, and if this account is placed in the hands of an attorney for collection or collected through legal proceedings, there shall be added to the unpaid principal balance all costs of collection, including reasonable attorney’s fees and expenses, whether or not suit is filed.
Decking Costs: If decking is required but not covered by your policy, the homeowner agrees to have it replaced at $1.95 per square foot.
Satellite Dish Alignment: Bardin Roofing LLC is not responsible for the alignment of any satellite dishes on the roof.
Warranty Claims: You agree to immediately notify Bardin Roofing LLC in writing if you have a warranty claim.  You must allow Bardin Roofing LLC access to the defective item during normal business hours for inspection and repair or replacement.  If skylights are replaced, they are included in the workmanship warranty. If they are not replaced, they will not be covered by any warranty.  All warranties are void if you do not pay Bardin Roofing LLC in full for the work.  Manufacturers’ warranties are the sole responsibility of the manufacturer and may be subject to the manufacturer’s terms and conditions.
Delays: We are not responsible for delays caused by:
Delays in payment by you.  Changes in the work.  Acts of God.  Labor disputes or shortages.  Fire or other casualties.  Delays in material deliveries.  Adverse weather conditions.  Other causes beyond our control.
Changes: Any changes in the work shall be made by written change order signed by us and you at or near the time the changes are completed. We are entitled to receive payment for the cost of any change in the work, plus a reasonable amount for overhead and profit, even if you do not sign a written change order. If the change increases the contract price, the cost of the change shall be due and payable within seven (7) days after completion.
Supplemental Payments: Bardin Roofing LLC reserves the right to review its initial estimate and documentation provided by the insurance carrier or its agent and submit revisions or requests for supplements to your insurance carrier. You expressly agree that all proceeds from any approved submissions shall become part of this contract and are payable to Bardin Roofing LLC.
Control Over Work: We will direct and supervise the workforces, including subcontractors. You agree not to interfere with or issue instructions to the workforces. You will not contract for any additional work with any contractor or subcontractor unless we consent. Additional work must not interfere with our completion of the work.
Concealed Conditions: You will be responsible for the cost of any charges and changes caused by rotted wood, deteriorated sheathing or siding, existing code violations, or damage due to theft, vandalism, fire, wind, snow, rain, or other uncontrollable conditions. The contract price shall be increased and/or the estimated completion date extended if we encounter significantly different conditions than those indicated in the plans.
Financial and Other Information: If requested, you agree to provide information showing ownership interest and legal description of the property before and after signing this contract. You agree to promptly notify us of any changes in this information. The homeowner acknowledges responsibility for their deductible payment.
Costs of Collection, Forum Selection, and Interest: You agree to pay any reasonable attorney’s fees and costs if we hire an attorney to enforce this contract. If we are sued and prevail, you agree to pay our defense costs. You agree to the exclusive jurisdiction of the State or Superior Court of Cherokee County, Georgia. The scope of work is complete once the insurance company releases final payment or we send the final invoice. If we file a mechanic’s lien, you agree to pay the costs, including reasonable attorney’s fees. Late payments incur interest at 1.5% per month.
Notices: Any required notices shall be sent to the addresses stated in this contract or as notified in writing. Notices are effective when received if personally delivered or when mailed by US Mail, first class or certified mail, properly addressed and postage prepaid. Notices will also be sent via email.
Miscellaneous: Either party may use its legal rights and remedies in any combination. Using one or more rights and remedies does not waive the right to use them on future occasions. Any exhibits are part of this contract. Captions are for convenience only and do not change the terms. This contract contains the entire agreement between you and us.
